By downloading, installing, or using the Eat At Home app ("the App"), you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree, please do not use the App.
These Terms constitute a legally binding agreement between you and Eat At Home LLC, a Delaware limited liability company ("Eat At Home," "we," "us," or "our"). By using the App, you also acknowledge that you have read and agree to our Privacy Policy, which is incorporated herein by reference.
Eat At Home is a personal finance and lifestyle app that helps users track money saved by cooking dinner at home instead of dining out or ordering from restaurants. Savings estimates are calculated based on user-provided data and general pricing references and are intended for informational and motivational purposes only. They do not constitute financial advice. See Section 7 for our complete Financial Disclaimer.
You must be at least 13 years old to use the App. If you are under 13, you are prohibited from using the App and must not attempt to create an account or submit any personal information. By using the App, you confirm that you meet this age requirement. If you are under 18, you represent that a parent or guardian has reviewed and agreed to these Terms on your behalf and accepts responsibility for your use of the App.
To access certain features, you may be required to create an account. You agree to:
Eat At Home LLC reserves the right to suspend or terminate accounts that violate these Terms, are used for fraudulent purposes, or have been inactive for an extended period. We are not liable for any loss or damage arising from your failure to maintain the security of your account credentials.
The App offers optional integration with your financial accounts through Plaid Technologies, Inc. ("Plaid"). By connecting a bank account, you acknowledge and agree to the following:
You agree to use the App only for its intended, lawful purpose and in compliance with all applicable federal, state, and local laws and regulations. You may not:
Eat At Home LLC reserves the right to suspend or terminate your access immediately and without notice for any violation of this Section and to pursue all available legal and equitable remedies.
Eat At Home LLC is not a bank, financial institution, investment adviser, credit counselor, or financial planner, and is not licensed or regulated as any such entity. The App is an informational and motivational tool only.
All savings estimates, calculations, and financial figures provided by the App are approximations based on data you provide (such as estimated spending, household size, and cooking goals) and general, publicly available pricing data. These estimates:
You should consult a qualified, licensed financial professional before making any financial decisions. Eat At Home LLC expressly disclaims all liability arising from any reliance on estimates, calculations, or information provided by the App.
All content within the App — including but not limited to its name, logo, design, text, graphics, interfaces, software, and underlying code — is owned by or licensed to Eat At Home LLC and is protected by United States and international intellectual property laws. All rights not expressly granted herein are reserved.
Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable, non-sublicensable personal license to use the App solely for your personal, non-commercial purposes. This license does not include: (a) any right to sublicense, sell, or transfer your rights; (b) any right to modify, adapt, or create derivative works; (c) any right to use App content for commercial purposes; or (d) any right to remove or alter proprietary notices or labels.
You retain ownership of any content you submit to the App (such as meal entries or photos). By submitting content, you grant Eat At Home LLC a worldwide, royalty-free, non-exclusive, sublicensable license to use, store, reproduce, modify, and display that content solely for the purpose of operating and improving the App's features for you.
If you download or access the App through the Apple App Store, you acknowledge and agree that: (a) these Terms are solely between you and Eat At Home LLC, and not with Apple Inc. ("Apple"); (b) Apple has no obligation to provide any maintenance or support services for the App; (c) in the event of any App failure to conform to any applicable warranty, you may notify Apple and Apple will refund the App purchase price, if any; (d) Apple is not responsible for addressing any claims you or any third party may have relating to the App; (e) Apple and its subsidiaries are intended third-party beneficiaries of these Terms and, upon your acceptance, will have the right to enforce these Terms against you.
If you download or access the App through Google Play, you acknowledge and agree that these Terms are solely between you and Eat At Home LLC, and not with Google LLC ("Google"). Google has no obligation to provide maintenance, support, warranty, or other services for the App, and is not responsible for any claims relating to the App.
You must comply with all applicable third-party terms of service and policies when downloading, accessing, or using the App through any platform.
THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, EAT AT HOME LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, AND SERVICE PROVIDERS EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WITHOUT LIMITATION:
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU IN FULL.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL EAT AT HOME LLC OR ITS OFFICERS, DIRECTORS, MEMBERS, EMPLOYEES, AGENTS, LICENSORS, SUPPLIERS, OR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES OF ANY KIND, INCLUDING WITHOUT LIMITATION:
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, EAT AT HOME LLC'S TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS SHALL NOT EXCEED THE GREATER OF: (A) THE TOTAL AMOUNTS ACTUALLY PAID BY YOU TO EAT AT HOME LLC IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE CLAIM; OR (B) FIFTY U.S. DOLLARS ($50.00).
To the fullest extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Eat At Home LLC and its officers, directors, members, employees, agents, licensors, suppliers, and service providers from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, expenses, and fees (including reasonable attorneys' fees) arising out of or relating to:
The App may integrate with, link to, or rely upon third-party services and platforms, including but not limited to Plaid Technologies, Inc., cloud hosting providers, analytics tools, customer support platforms, and app distribution platforms (Apple App Store and Google Play). We are not responsible for the content, security, availability, privacy practices, or policies of any such third-party service.
Your use of third-party services is governed entirely by those third parties' own terms of service and privacy policies, which we strongly encourage you to review before use. Eat At Home LLC makes no representations or warranties regarding any third-party service and shall not be liable for any loss or damage of any kind arising from your use of or reliance on any third-party service.
Eat At Home LLC shall not be responsible or liable for any delay, failure, or interruption in the performance of its obligations under these Terms to the extent caused by circumstances beyond its reasonable control, including but not limited to: acts of God or nature; natural disasters; pandemic or public health emergency; war, armed conflict, terrorism, or civil unrest; governmental actions, laws, regulations, or sanctions; power outages or failures of telecommunications infrastructure; cyberattacks or security incidents caused by third parties; or failures or outages of third-party service providers, including Plaid Technologies, Inc. or cloud hosting providers.
You may stop using the App at any time. You may request deletion of your account by contacting us at support@eatathomeapp.com. We reserve the right to suspend, restrict, or terminate your access to the App at our sole discretion, with or without cause and with or without prior notice, if we believe you have violated these Terms, engaged in fraudulent or illegal activity, or if we discontinue or materially modify the App.
Upon any termination: (a) your right to use the App ceases immediately; (b) all licenses granted to you under these Terms are revoked; (c) we may delete your account and associated data in accordance with our Privacy Policy; and (d) Sections 7, 8, 10, 11, 12, 16, 17, and 18 shall survive termination.
Please read this section carefully. It significantly affects your legal rights, including your right to file a lawsuit in court and your right to a jury trial.
Before initiating any formal legal proceeding, you agree to first attempt to resolve any dispute informally by contacting Eat At Home LLC at support@eatathomeapp.com with a written description of your claim and your desired resolution. Both parties agree to negotiate in good faith for a period of thirty (30) days following written notification.
If informal resolution fails, you and Eat At Home LLC agree that any dispute, claim, or controversy of any kind arising out of or relating to these Terms, the Privacy Policy, or your use of the App will be resolved exclusively by final and binding individual arbitration, rather than in court, except as provided in Section 16.7. The arbitration shall be conducted by the American Arbitration Association (AAA) pursuant to its Consumer Arbitration Rules (available at adr.org). This Arbitration Agreement is governed by the Federal Arbitration Act (9 U.S.C. § 1 et seq.).
Arbitration may be conducted by telephone, videoconference, written submissions, or in person in the county of your residence or in Wilmington, Delaware, at your election for claims of $10,000 or less. The arbitrator may award any relief that a court could award on an individual basis.
YOU AND EAT AT HOME LLC AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS ACTION, COLLECTIVE ACTION, OR OTHER REPRESENTATIVE PROCEEDING. IF THIS CLASS ACTION WAIVER IS FOUND UNENFORCEABLE AS TO ANY PARTICULAR CLAIM, THEN THAT SPECIFIC CLAIM SHALL BE SEVERED FROM THE ARBITRATION AND MAY BE PURSUED IN COURT.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, YOU AND EAT AT HOME LLC EACH IRREVOCABLY WAIVE ANY RIGHT TO A TRIAL BY JURY IN ANY ACTION ARISING OUT OF OR RELATING TO THESE TERMS OR THE USE OF THE APP.
YOU MAY OPT OUT OF THIS ARBITRATION AGREEMENT BY SENDING WRITTEN NOTICE TO support@eatathomeapp.com WITH THE SUBJECT LINE "ARBITRATION OPT-OUT" WITHIN THIRTY (30) DAYS OF THE DATE YOU FIRST ACCEPT THESE TERMS. YOUR NOTICE MUST INCLUDE YOUR NAME AND THE EMAIL ADDRESS ASSOCIATED WITH YOUR ACCOUNT.
Either party may seek relief without first completing the informal resolution process or arbitration for: (a) any claim that individually qualifies for small claims court; (b) emergency injunctive or temporary restraining order relief to protect intellectual property rights or prevent imminent, irreparable harm; and (c) an action to confirm, modify, vacate, or enforce an arbitration award.
Filing, administration, and arbitrator fees shall be allocated in accordance with the AAA Consumer Arbitration Rules. For disputes involving claims of $10,000 or less, Eat At Home LLC will pay all such AAA fees, unless the arbitrator determines that your claim was filed in bad faith or for an improper purpose.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, ANY DISPUTE MUST BE FILED WITHIN ONE (1) YEAR AFTER THE DATE THE CLAIM OR CAUSE OF ACTION AROSE, OR IT SHALL BE PERMANENTLY BARRED.
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law principles. To the extent any dispute is not subject to arbitration under Section 16, you and Eat At Home LLC each irrevocably consent to the exclusive personal jurisdiction and venue of the state and federal courts located in the State of Delaware.
If any provision of these Terms is found to be invalid, illegal, or unenforceable under applicable law, that provision shall be modified to the minimum extent necessary to make it enforceable, or if modification is not possible, severed from these Terms, and the remaining provisions shall continue in full force and effect.
These Terms, together with our Privacy Policy and any other policies or agreements expressly incorporated herein by reference, constitute the entire agreement between you and Eat At Home LLC with respect to the App and supersede all prior and contemporaneous agreements, representations, and understandings regarding the subject matter hereof.
Our failure or delay in exercising or enforcing any right or provision of these Terms on any occasion shall not constitute a waiver of that right or provision.
You may not assign, transfer, delegate, or sublicense any of your rights or obligations under these Terms without our prior written consent. Eat At Home LLC may freely assign, transfer, or delegate these Terms and any rights or obligations hereunder, including in connection with a merger, acquisition, or sale of all or substantially all of our assets.
You agree that your access to or use of the App constitutes your electronic signature and legally binding acceptance of these Terms. Electronic agreements, consents, and communications are legally equivalent to written agreements signed in ink, as provided by the Electronic Signatures in Global and National Commerce Act (15 U.S.C. § 7001 et seq.).
Notices from Eat At Home LLC to you may be provided by email to your registered address, by in-app notification, or by posting within the App, and shall be effective upon transmission. Notices from you to Eat At Home LLC must be sent to support@eatathomeapp.com.
Except as expressly set forth in Section 9 with respect to Apple Inc. as a third-party beneficiary, these Terms do not and are not intended to confer any rights, remedies, obligations, or liabilities upon any person or entity other than you and Eat At Home LLC.
You represent and warrant that you are not located in, and are not a national or resident of, any country to which the United States has embargoed goods or services, and that you are not named on any U.S. government list of prohibited or restricted parties.
Eat At Home LLC reserves the right to modify these Terms at any time at its sole discretion. When we make changes, we will update the effective date at the top of this document and notify you within the App. For material changes, we will provide more prominent advance notice, which may include email notification to your registered address. Your continued use of the App after the updated Terms are posted constitutes your acceptance of and agreement to the updated Terms.
